In the past few years, the popularity of investors has increased rapidly. It is a step-by-step guide in which we will provide all the basic and advanced information about the EB-5 visa investment and immigration to the US.

What is EB-5 visa investment for US immigration?

This investment allows you to become a green card holder for two years by investing in US commercial enterprises. It is an excellent investment through which people can immigrate to the United States. The applicants can stay there with their spouse and children who are unmarried and below 21.

You can invest USD 500,000 or USD 100,000 into an American business to obtain an EB-5 visa. This investment has been named EB-5 because participants receive fifth-preference visas based on employment. It will preserve ten permanent full-time jobs for qualified US workers with a legal permanent residency of two years. USCIS administers this investment.

To stimulate the US economy through capital investment by investors and job creation Congress created this investment program in 1990. The Regional Center Program was created by Congress in 1992 for immigrant investors.

How to apply for an EB-5 Visa?

After settling your investment, you can apply for an EB-5 visa, for which you will have to follow some processes and submit some required documents. By using the form I-526, you can apply for an EB-5 visa. The applicant needs to fill out this form for the EB-5 visa process. You must check the submission address on their website before submitting the form.

After this process, USCIS reviews the application and sends it to NVC. After the review of the form by NVC, they contact you to submit the required documents and pay the relevant fees. They will also inform you how and where to pay the amount.

After the completion of these processes, you will have to face an interview at the US embassy. The NVC will inform you where the discussion will be held and what documents you must bring. After the consultation, the US embassy will issue the immigrant investor visa to you, which will be a two-year green card.

What time will the process consume?

Approximately 13 months will be consumed from submitting the form to USCIS for an EB-5 visa. It is an approximate process time; the time period may be longer or shorter depending on your conditions and documents.

How long can you stay with an EB-5 Visa in the US?

As mentioned above, the EB-5 visa is a two-year green card, meaning if you have received a green card through an EB-5 visa investment, you will get a conditional residency. The green card will be valid for only two years, and you can extend your residence by applying for unconditional or permanent residency.

By applying for permanent residency, you will get ten years of green card and can renew it continuously. While during those two years, you can live, study or work and only be out of the country for up to one year; otherwise, you will lose your residential status.
