  • Can I win this case?

    Two nights ago, my fiance and I financed a puppy with a pet store. When we bought the puppy, we were told that we had a 48 hour return policy. The puppy was $3157. On our first night the dog was barking and we got a knock on our door from one of our neighbor (friendly neighbor of our) saying that dogs were not allowed. We always assumed they were because other tenants have dogs but we didn't know those apartments were individually owned. We didn't want problems so we returned the pup the next morning. When we got to the store they told us they only refund 50%!! so we will have to pay $1800 just to return. After speaking to the manager he said he was able to refund the whole amount on the financing credit card, but since we were being rude this morning, he wants us to pay 820 in cash in order for him to refund our money! So we paid the 820 but decided not to give him cash and did it with our debit card. If I claim that 820 with my bank, would they be able to trace what he charged us for since he refunded everything on our CC. (which I closed this morning btw). Do we have a chance to fight this? This is so unethical and outrageous and to be treated like this by a company is completely insane. Charging us because he felt we were being rude and asking for cash! What can we do? Can this bite us in the ass if I do make a claim on this random charge?

    My first though is that this is a phony thread.

    Who in the heck pays over three grand for a dog?
    Who in the heck would even think about financing a dog?

    If this is for real, my apologies for coming off as rude, but that was a horrible move on your part.
    Get the law involved if you truly think you have been cheated.

      if its not in writing you will probably lose in court because everyone in court lies and the shop owner will deny everything you alledge, i watch a lot of judge judy

        It is normal for pets to have a hard adjustments the first few weeks at a new home.

        Normally Pet stores and adoption agency will ask if you are a homeowner or not and if you have approvals to have a pet at your resident before signing the contract for the very reason you provided in your post.

        If the apartments are individually owned, have you asked your landlord if you can have a pet? Normally this is also stated in your lease contract. I would have asked instead of taking your neighbor's word right away as it might be possible it is a different owner for her unit.

        But as far as your question, you will need to review the paperwork you have signed and read all of the fine prints. Did it say anywhere that you will get full refund or partial refund if returned the pet by a certain time frame. Everything has to be in writing, including the shop's side. So it all depends on what the paperwork/contract says if you have a case or not.

          You don't adopt dogs and bring them into your home unless it's their forever home. At least check to see what the pet policy is in your current place before going out and buying a dog. -duh?

            You got blackmailed. But you did something incredibly stupid. You'll probably never get your money back. Next time, check the pet policy. Then get a dog from your local shelter for $50.

              Ignore the other unhelpful comments, what's done is done.

              Sounds like you need proof of the policy and proof that the store's policy was 48 hours and you returned the dog within that period.

              Then go to small claims court. If you lose you lose.

              Edit: not that I don't agree that financing a dog was a dumb decision. Live and learn, hopefully.

                      So even if they had kept this $3K+ dog, who gets him when the marriage doesn't happen and the couple breaks up? You will need a pre-nup for the dog alone! I would have flat out refused to pay 'cash', left the dog at the store and gone home and called your credit card company or were you supposed to be paying money monthly to this pet store? Sorry, but the whole thing sounds silly. If you truly wanted a PET go to the shelter. I would think the only reason to pay so much for a dog is for breeding and showing purposes and then you should have/would have done a whole lot more research. The whole things sounds like something you did on the spur of the moment.

                          Tom, as one of the site moderators, I wanted to respond to this. And I'm speaking stictly for myself here, not the other moderators.

                          My first priority is removing outright spam. I think we do a pretty good job of that.

                          When it comes to troll posts, it's not so clear cut. I have found that sometimes the troll posts spur some really interesting and worthwhile conversation. In those cases, I'll leave them alone. Other times, the troll posts are just so ridiculous (like this one) that I leave them alone purely for the entertainment value. Heck, if we can't laugh at utter stupidity, what can we laugh at?

                          The only time I tend to quickly delete troll posts is when they are about entirely non-financial issues that don't belong on this site or if they are being rude or inappropriate in some way or harshly pushing some religious or political agenda in a way that I feel is inappropriate.

                          So yes, I encourage people not to feed the trolls, but I recognize that sometimes it's educational to others who might actually agree with what the trolls have posted.

                            You do a great job moderating and I would not have deleted this post as spam. We seem to get a lot of 1 post wonders on here. I guess they don't like what we tell them (I sure didn't when I first checked in). Between them and the 15 post "I wanna post a really, really important link" newbies, we get a lot of noise on the fora.

                              If you can afford a $3000 dog, I don't see what everyone's issue with that fact is. Personally I won't spend more than about $0 on a dog, but hey that's just me.

                              Considering that you live in an apartment, you should understand all of the rules there of. Your ignorance of your rental agreement got you in this position.

                              Before spending this munch money for an animal, I would have requested, acquired, and read the return policy. A clerk simply stating they have a 48 hour return policy is not enough for me.

                              Had you decided to have kept the dog, and say in 3 months the dog got sick and died, you may have still been eligible for a refund or legal recourse, especially if you could show the dog had some birth defect due to being pure breed.

                              At this point, I would go after them with a lawyer for my $800.

                              And just out of curiosity, what is the name of the business?? You might consider doing some research on them prior to making the purchase. Chances are that $3000 puppy in the window would still be there the next day.
