      Could that be called stealing if someone lets me claim their child? I did not steals anyone identity I have seen people doing that all the time claiming kids It never crossed my mind that I was stealing federal refund in my situation as I was given to claim someone and file as head of house hold

            Yes, that is most definitely tax fraud. You claimed a dependent who isn't actually yours. You aren't the one financially providing for that child. You have no legal right to claim that child on your taxes.

              I see you got the point I took it as if when the parent let me claim the child in a form of helping me out financially due to my situation as I dint force anyone to do that

                Nope, you cannot take someone else's tax deduction, period. That isn't how the law is set up. Perhaps in the UK this is allowed, but not in the USA. Especially since the IRS will see that you don't claim this child next year or the years after. Even divorced parents unless they are the ones providing 51% or more of the child's financial needs can't claim them! If a child's parent at times can't claim them, you surely can't claim someone else's child unless you want to marry that woman and make it official - and I wouldn't recommend it. Both you and she can get in trouble with the IRS. I don't know how their computers work, but eventually one is going to spit out a letter to you and her and it won't be pretty as you will not only have to pay the money back, but also pay fees and interest on the money you got illegally starting from day one. Sorry for the bad news on this one.

                Not sure how much the actual amount that you ‘borrowed’ on your income tax by claiming her child, as that part of your note was a bit convoluted. However much it was, you need to fess up and start paying back the IRS ASAP. I believe that they have payment plans but not sure. I haven't had young children in the home for years at this point, but unless your friend is making oodles of money and isn't eligible for the credits that come with having children as well 'giving away' a major tax deduction, her tax return was probably less than it could have been, since it sounds like she did her taxes herself as no tax preparer worth their name would have let her get away with this.

                Very good on reaching 6 months abstaining from using escorts. Also, very good on working on the other bills. Wish you would have come to us and asked first about the child deduction swap, we could have set you straight.

                    Actual difference was $3500 as I usually get 3500 from my tax refund with adding a dependent it bumped to $3500 tax was done on February so till now no letters from nobody, I jus talked to my co-worker she told me she been doing this thing for years she always let her 4th child be claimed by people who she want help and it has NEVER ever caused a problem and never got a letter from IRS and told me not to worry at all about this if there was a problem I would have never got a refund instead a letter would have been sent but you never know will pray for the best. odds of being audited is way down due to the amount of money I make.

                        If your coworker wants to help people, she should write them a check.

                        Just because you may not get caught doesn't make what you did any less illegal.

                          While she might not have been caught and you didn't get caught YET, the IRS loves to send letters to folks several years after the filing date and ask what was going on. Just because you haven't been caught YET, doesn't mean it isn't a dishonest, highly illegal thing to do or that you won't be caught eventually. I assume that at this point you have heard of Bonnie and Clyde? What finally brought them down was their not filing their taxes correctly including the money that they had robbed from others! Even if you make your income illegally, such as prostitutes in states where it is illegal, they still have to report all their earnings as do drup dealers, etc. Considering that she is passing off her child to different folks each year, unless you are using a fake Social Security number for the kid each time, the computers are going to catch it. Because there are just so many folks that can be claiming the same child.

                            Tdi, good for your addressing this - you may not see results overnight, but addressing your behavioral challenges will help you in the long run. It takes some time to develop new, healthy habits.

                            Have you given any thought to coming clean with your mom about the amount of money you have taken out of her account? That might help your conscience and improve your relationship with your mother.

                              His update above addressed this. He repaid his mother by fraudulently claiming another person's child on his taxes so he could get a bigger refund.

                                I would assume he is declaring his mother. It is a friend's kid that he can NOT do. It is tax fraud and it will get caught unless he is making up SS numbers. (and that could trip him up as well). Until those numbers were required some folks added in their 'fur kids' as deductions. But the SS number is to prevent that kind of fraud. If it were legal, you can bet that the there would be folks with businesses of 'renting' out children/adults for the tax deductions.
