  • We paid the interest on Student Loans, but father-in-laws name on them

    Hey -

So yeah, I have the above question. How do my wife and I get the tax deductions for making the student loan interest payments? Sallie Mae, who has them, said talk to your tax accountant. Don't want to waste time with that. How do I do it? Thx,

    Dan

Use this tool on the IRS site to see if you can deduct the interest you paid: http://www.irs.gov/uac/Can-I-Claim-a...an-Interest%3F

According to that IRS link, they are not eligible to deduct it, because they were not legally obligated to pay it. Father in law was the one who is "legally" obligated, since it is in his name.
