  • Car accident insurance question

    A few weeks ago, my car hit a patch of ice at a stop sign. My front tires got stuck in a small bank. As I was trying to get out another car hit me. I live in Kansas and I'm trying to find out whose at fault. So if anyone can point me to a website or forum that could give me some answers that would be great.

    If what I've read is right, Kansas is a 'no-fault' state which means that you will be responsible for the damages to your car and the other person will be responsible for theirs. If your insurance will not cover the damages then you may be able to file a claim against the other person's.

      Thanks, the damage is about $100, I just switched insurance companies and I think its too small amount for them to bother with.

        I think you should approach the the insurance company first. If they deny to fill up your claim then you can submit a legal file against them.

            I'm not sure how subrogation (if there is any) works in a no-fault state between insurance companies. If everybody pays for their own, then meh. But I'm pretty sure it's a requirement of any insurance policy to report an accident if you were involved in one, even if there's no expectation of payment or coverage of damage. You always want to have your story on file, especially in comparative negligence or "at-fault" states in case the other party tries to come after you.
            History will judge the complicit.

              I hope you got details of the other driver's name/address/phone number/employer/ DL number, insurer & contract number, car's plate numbers, make/model/yr. In our area any rear end collision is attributed to the 2nd driver. Have you had damaged assessed at a body shop? Can a dent just be pulled out with one of those gizmos? Involving your insurance in a tiny claim, even if they don't pay, is noted on your record. It can bump up your rates at the next increase or cause you to get dumped when they have three recorded 'events.'

              Our insurance gave us a form in card format with the above questions to keep in the glove box. Easy for anyone to re-create and so handy when stressed by an unexpected mash/crash
