  • OK to dispute when service was not performed?

    Hi,

    This is a first time situation.

    I paid extra for delivery that was not done according to our agreement.

    The owner of the store is not refunding the money and is giving me the runaround. He then offers me a little store credit even after the fact that I told him I will not be doing business with him again.

    Can I dispute this with my credit card company, or are disputes only for tangible products etc. ?

    This sounds like you received delivery, but part of the agreement was to set up said delivery, which did not happen. Am I close?

    My understanding is that you CAN dispute just about anything with your CC company, but if you're going to argue that services were not rendered as agreed upon/paid for, you'd better have some stone cold evidence of it, like a delivery agreement document and delivery invoice (stating items delivered and services rendered/not rendered upon delivery). Disputes about goods are much easier, becuase they are either there or not there; intact or not intact. Disputes regarding services rendered are tough, because in most cases (except where there is thorough documentation), it's one person's word against the other's.

        You can also inform this owner that you will advise all of your friends not to purchase items or service from him either. Generally, some store owners will view this as an empty threat, but there's always a certain amount of doubt. What goes around comes around and when you broaden the liklihood that his breaking his agreement has a potential of losing him business from other people that may also ask you about this transaction with him, that tends to mean a bit more than the loss of one customer.

        Disputes are for more than just tangibles. If you have a documented agreement and he or his people did not fulfill that portion of the agreement, there should be some agreed upon reimbursement for that lack. Yes, dispute it.

          One more bit of advice.

          Go back to the store owner and tell him that you will be disputing the extra charge that is on the receipt for the additional costing service that he did not perform. Thereby giving yet another opportunity for him to pay you back for the service not performed. Know that many store owners do not like blackmarks with the CC companies.... and will refund the monies straight away before you submit that dispute in the first place.

          Many service oriented companys have their stores on resellerratings.com and if this store/service is listed there, you may have yet another avenue of telling the owner that you will not be silent about this.

          The public has the right to know about stores/services that do not honor their agreements.

            i consider a dispute with your credit car company. its their job to do it properly.
