I'll have to be honest, I don't 100% understand what you mean by a "stay". Does that mean with the dates I provided that the late payments and collections should be taken off of his record?

Oh in other good news. His Macy's card is in fact still open, they are sending him a new store card today without a credit check. I'm finding it H-I-L-A-R-I-O-U-S that the bankruptcy place made a mistake that is probably going to help him out quite a bit!

A stay of action in regards to bankrupcy means a "pause" from your creditors on all debts. Interest, fees, and all activity to try and collect on your debt must immediately halt. After the stay is over, everything unpauses and they can start up their activities and reporting again, unless the court rules the debts were discharged. People would never be able to delare bankrupcy if the amount they owed changed every day from interest and fees. Imagine the paperwork from that! That's why the law includes the "automatic stay" section.

If he filed his Chapter 7 petition on April 7th, 2004 there should be no activity on his credit report after April except for the note of the bankrupcy itself, assuming all accounts were discharged. Any account discharged should not have any additional monthly history remarks like late payment notices after filing for BK.

It's possible the courts made special considerations and eliminated the stay early or entirely, but that is not likely. Dispute the items again, and see what the credit bureaus say. Even try disputing the remarks for the month of April. Depending on how they were reported by the credit cards, they might qualify for removal, too (it depends on billing cycle and statement dates among other things).

        UPDATE:

My partners disputed Experian credit report just came back. Two of four errors on his credit report were completely deleted. The other two were updated "Petition for Chapter 7 Bankruptcy/Never late" and "Discharged through Bankruptcy Chapter 7 [with no late payments on it]". Freakin' awesome.

And he did get that Macy's Card with no credit check. He made a $3 purchase on it and will be paying that off this month.

No onwards to understanding the other two credit reports and disputing with them.

I'm extremely excited that disputing the incorrect things on his credit report were fixed, I know in the past he has tried and has had issues. This will surely help out his FICO score!

to Experian. Onwards to Equifax and TransUnion.
