  • Microsoft seeks money from laid-off workers

A few weeks after launching the first wide-scale layoffs in its history, Microsoft Corp. admits it messed up a key part of the plan.

The company is asking some laid-off employees for a portion of their severance back, saying an administrative glitch caused the software maker to pay them too much.

I wonder what the legalities of that are. What if a former employee has already spent the money? What happens then? Does the company have the right to go after the employee for the overpayment?

I know the government can... my mother left teaching for DoD schools, then a year later was notified she had been overpaid because of some technicality. She tried fighting it, but ultimately ended up having to repay it all.
