  • Writing a Financial Advice E-book...Do I Need Disclaimers?

    Hi all,

Have really liked the advice I've received on these forums. Here's another questions I have: I am writing an e-book which basically advises you to purchase into emerging markets index funds and small-cap stock funds and hold them during your working career so you retire with millions. I recommend some specific funds in the book and strategies to protect yourself from long-term losses. I am planning on selling this e-book. Do I need to legally protect myself from lawsuits, and if so, what type of disclaimer would do so? Thanks for your help in advance!

    Hire an attorney

I think its great that you are inspired to write this book I would love to read it. Per your question, I too have a knack for creating financial products. My advice is get an attorney. I say this because the digital world is becoming a litigious battlefield. You will have to make several disclaimers like advising people that your thoughts are based on personal opinion and that anyone considering implementing them should contact a professional. This is merely to CYA. When giving advice about non-insured products you enter the realm of suitability and is your advice uniform for everyone or do certain financial checkpoints need to be met. Also if someone loses money per your advice will they want to come after you because they hold you responsible. So again many variables and the best person to give you advice will be an attorney well versed in the field. Best of luck!
