    Dear friends, recently I have purchased a used vehicle from a private seller of MA. I can not get it inspected in NYS because the inspection system will not pass the emissions on the car. Do I have a leg to stand on if I try to return the car and get my money back?

    If you have a document that he states it is in legal working condition, you might. In general, this is one of those things you should check before buying.

    Like with selling a home, there may be a disclosure law for your area, I would check to see if this is the case.

      Typically when you buy a used car it's "As Is". Just repair the issue...possibly an O2 sensor or catalytic converter.

          You probably can't give the car back. Emission standards and testing vary by state. The car may have passed in the state that you bought it. However, if your car's performance is not effected, then it's probably something simple in your emission control system. O2 sensor, bad module or relay someplace, or the cat convertor. All are easy, relatively inexpensive fixes. I would just repair it and not worry about trying to get out of the deal.

            nyc has very strick emissions laws it could be alot of things causing the problem if you are not car savy try telling the person either he takes the car back or pays for the repairs or you will take him to small claims court< what kind of car is it and how much did you pay

              Take the car back or take him to court?

              Unless there were specific agreements stating the cars condition in the bill of sale, the buyer really has no recourse with the seller. Most all cars are sold "As Is" unless otherwise stated.

                  nope, you have no legal legals. NONE, even if you bought it from someone in your state who claimed it is in great running condition. Used car sales are always AS IS always a contract is written implying warranty or that it will pass inspection.

                        I really doubt that you can return the car. Try to get the car fixed and use this experience to learn so next time you buy used card you will know what to do. Get it inspected by a certified mechanic.

                          In most states private party cars sales are "as is." Even if you have a contract written in blood it is invalid because the law states "as is"
