Dear friends, recently I have purchased a used vehicle from a private seller of MA. I can not get it inspected in NYS because the inspection system will not pass the emissions on the car. Do I have a leg to stand on if I try to return the car and get my money back?

If you have a document that he states it is in legal working condition, you might. In general, this is one of those things you should check before buying.
Like with selling a home, there may be a disclosure law for your area, I would check to see if this is the case.

You probably can't give the car back. Emission standards and testing vary by state. The car may have passed in the state that you bought it. However, if your car's performance is not effected, then it's probably something simple in your emission control system. O2 sensor, bad module or relay someplace, or the cat convertor. All are easy, relatively inexpensive fixes. I would just repair it and not worry about trying to get out of the deal.Brian

nope, you have no legal legals. NONE, even if you bought it from someone in your state who claimed it is in great running condition. Used car sales are always AS IS always a contract is written implying warranty or that it will pass inspection.
