  • This makes me sick

I feel so bad for these people. We've been the victims of a frivolous lawsuit, and it just disgusts me how the system allows this stuff to happen. Even when you "win," you don't really win because the attorney fees wipe you out.

Judge sues cleaner for $65M over pants - Yahoo! News

I agree! I read about this a few days ago and couldn't believe a judge was doing this. I read another article that says he is being reviewed now and could lose his job, or at least not be appointed to another term...

His case should be dismissed, he should be disbarred, and he should have to pay for all the court and lawyer fees he has caused.

That is such an abuse of power- if he can't handle it he shouldn't be given any more

We were sued for over $7000 for some silt fencing. My husband started a job but he and the owners did not get along, so we gave them their money back and he hired a new builder.
The owner decided that the silt fencing was not tall enough and sued for $7500. The silt fencing cost about $100.
                We won, thank goodness.
The guy was really suing us because he decided to move the driveway and that is what it cost him for the new drive.

Oh yeah - I saw this. IT was like part of the lawsuit was $25k for leasing a car to find another cleaners??????? Wha???

& the poor couple was so stressed out about it all - seems they should legitimately be able to counter-sue for distress or something - my word.

                  It's disgusting.

I think the judge was trying to make a point.

Also, the judge could be very slightly racist, and the foreigners could seem to blow him off by not speaking English, fueling his anger.

Anyone who gets bent out of shape over not being able to wear his favorite pants is unfit for holding a responsible position. For crying out loud he must have had some perfectly OK other ones to wear.

                        Won't win

                        He won't win.

He's being a bully. And if he does win he'll get maybe $1000 for the pants. But that won't happen. Because who wears $1000 pants? And then the judge would have to depreciate the pants to the actual value.

The guy is doing this to get them to spend more money on a lawyer then they have to.

Remember that McDonalds hot coffee lawsuit? The people never actually got that. It was appealed and overturned.

I read this story as well. As a lawyer who has worked on a few high profile cases, I can tell you that the newspapers rarely get the full story and that this particular report was a bit more sensationalized than it needed to be. I tend to agree that this case, assuming it is successful at the trial court level, won't withstand any kind of appellate scrutiny.

However, I don't think the only lesson to be learned from this story is about the quirks in the judicial system. Since this couple was apparently bearing the costs of the litigation on their own, they almost certainly did not have any liability insurance for their business. Had they had appropriate business insurance, they would not be concerned about financial ruin from an overzealous litigant. When my husband started his small business, we made sure we had a business liability policy in effect from Day 1. The expense is well worth it to us because we know our personal assets are not at risk from business-related lawsuits.

That story made me mad. I now have to pay for therapy for the next 40 years. I am going to sue that judge for 100 gillion dollars.

                            He should be fired.

You just can't make stuff like this up. What a jerk for abusing the legal system in such fashion!
