From what I understand, when an employee performs in their contractual capacity as an employee for an employer, all work products belong to the employer. As such, the employee has no expectation of privacy for work products because the work products belong to the employer to do as the employer wish.

I was briefed on this when the issue of email privacy at work, i.e. there is none.

I think the reference to defamation pertains to the character of the ex-employee. I believe if you confine your comments to the quality of the work performed, that's not considered defamation.

My company is about to make some changes that could result in layoffs in the next week or so so I may also be let go. We have a mortgage, car payment, student loans and cc debt. It's all pretty daunting. But I'm already job hunting and sending out resumes. I've been laid off before and I can tell you that there is life after being let go. In fact, I ended up better off financially with the package that I got. And I got a better job too. I'm sure that you can move beyond this. One thing you will need to do is to prepare for any questions during an interview around why you left your last job. You'll need to rehearse a response that puts you in the best light.
