Need Advice for Salary Problem

Hello

My Company is paying $ 500 less to me from last 8 months. There inability to rectify this problem seems to be big concern for me . As per there knowledge, it is system problem.
Can anyone please advice how i should handle this in legal way.

Sounds like you're going to need a lawyer. Unfortunately a lawyer's going to cost you a lot more than $500.

Not necessarily. If your income is below a certain level, you may be able to get help from Legal Aid. Call the bar association in your state (I don't know what state you're in, but it's probably listed under "X State Bar Association") or county, and ask what assistance is available for an employment dispute. If you're not eligible for Legal Aid, you may be able to get a lawyer at a reduced fee. At the very least, you could get a free or low-cost consultation to find out what your options are. Good luck!

You don't want to be seen as an enemy within, so in the mean time try your best to resolve it within and if that don't work, seek legal advice.
They acknoledge that you've been underpayed, surely then next step should be to compesate you!
'system problem' is not a reason, it certainly shouldn't be your problem, there's a contract between you and your employer, not paying you fully is breach of contract on their part..

Thanks for your response . My only concern is i waited for 8 months now.. I think i should follow your advice and give them some more time.

Maybe you could also check with your state's department of labor -- there might be some action that can be taken.

I have a feeling we're not getting the whole story though.

First thing I would do is write a letter to whomever pays your checks. In your letter, explain the problem and ask for a written response. Be polite, and send the letter certified with return receipt requested.

You need to begin documenting the problem in case you do need to go to court.

If they do not respond in 30 days, you can probably take this to small claims court yourself. Explain it to the judge just like you explained it here, and bring any evidence you have, like paystubs.

It's not absolutely necessary to get lawyers involved for small amounts. Keep in mind, if your employer does not want to pay you $500, he is not likely to pay an attorney either.

If there excuse is system error then what if you were overpaid $500,000 per week? I bet the "system error" would be fixed within a day!

Who are you talking with at your company? I would tell everyone I could. The HR dept, the owner, payroll dept and any supervisor in it, my supervisor, the payroll company processing the pay. It would seem someone would be able to handwrite you a check for the amount underpaid. I also might just give my notice to see if that gets anyones attention.

I personally don't think more time will help anything. You need to be aggressive about your pay. You are the one that has the most vested interest in it. No one else will care as much as you do and legally that money is yours. Do not sit around waiting. Do something. Talk to more people.

For eight months?! That is crazy. Write a letter to the Human Resources director with a Copy to the CEO and CFO and your direct supervisor. Include copies of all your paychecks and give them until next pay check to get all your money back. And ask tell them that since you hae been such a good sport about this, yo hope they return the favor and pay you some interest on the money. If you had had this cash in your savings account how much more would you have now? They screwed up, they need to pay up. Furthermore, if you are the only one having this problem tell them that you feel singled out and that this has affected your morale. The whole administration owes you an apology. If thext pay check is not a fat one, start calling an employment law attorney.
